Buildings Energy Efficiency Ordinance (Cap. 610)

The Buildings Energy Efficiency Ordinance (Cap. 610) had been enacted in November 2010 (please click here for the brief account of the Ordinance).

Two subsidiary regulations under the Ordinance, namely Buildings Energy Efficiency (Fees) Regulation (Cap. 610A) and Buildings Energy Efficiency (Registered Energy Assessors) Regulation (Cap. 610B) had also been enacted in March 2011. The subsidiary regulations provide detailed requirements on the fees and registration of Registered Energy Assessors (REAs) under the Ordinance.

The Ordinance will come into full operation on 21 September 2012. The core parts (Parts 2 to 6) of the Ordinance are now within the grace period. These parts are concerning the requirements for compliance with the Building Energy Code in new construction of specified types of buildings and in major retrofitting works of relevant building services installations, as well as the requirement for carrying out energy audit in commercial buildings. Hence, submissions in accordance with these parts of the Ordinance are not required before 21 September 2012. Application for registration as Registered Energy Assessor (REA) commenced

With the Buildings Energy Efficiency (Registered Energy Assessors) Regulation put in operation on 21 March 2011, applications for registration as REAs were opened up immediately (please click here for how to apply and click here for the Register of REA).

The Codes

EMSD has established a Technical Taskforce with the relevant trade parties, professional institutions, academics and government departments to formulate the new Building Energy Code (BEC) and Energy Audit Code (EAC) for the Buildings Energy Efficiency Ordinance. The BEC [PDF format (513KB)] and EAC [PDF format (347KB)] 2012 Edition have been gazetted pursuant to he Ordinance. Some energy efficiency design standards stipulated in the BEC 2012 Edition are more stringent than the voluntary BEC 2007 Edition with reference to the latest development of the relevant technology and practices in other regions. The building services installations should comply with the BEC 2012 Edition and the energy audit should be carried out in accordance with the EAC 2012 Edition under the Ordinance.

Soft Reminder:

The statutory requirement for compliance with the BEC (currently BEC 2012 Edition) applies to all major retrofitting works completed on or after the full operation date of the Ordinance, irrespective of the commencement date of the works. In other words, even the major retrofitting works are commenced before 21 September 2012, they are required to comply with the new BEC 2012 Edition if they are completed on or after 21 September 2012. If the responsible person of the major retrofitting works has difficulties to comply with certain requirements of the BEC 2012 Edition, the responsible person may apply, with justification, to EMSD for exemption from those particular requirements pursuant to section 20 of the Ordinance. The Technical Forms

The technical forms for the BEC and the EAC 2012 Edition are available at this website for download. The REAs are required to duly complete these technical forms to provide the necessary technical data in order to certify the compliance with the BEC or the EAC. After the full operation of the Ordinance, these technical forms should be submitted along with the above-mentioned forms for the implementation of the Ordinance.

The draft forms may be subject to change. The official version of these forms will be uploaded to this website for public's use in due course.
