The Panel

Pursuant to Section 44 of the Electricity Ordinance (Chapter 406) and Section 13 of the subsidiary Electricity Supply Lines (Protection) Regulation,the appeal board panel is established of which the panel members are appointed by the Secretary for Environment and Ecology. Not more than 5 persons are appointed from each of the following categories : -

  1. Registered professional engineers of the electrical discipline;
  2. tertiary educational institutions;
  3. electricity supply industry;
  4. organizations that he considers represent the interests of registered electrical contractors;
  5. organizations that he considers represent the interests of registered electrical workers;
  6. organizations that he considers represent the interests of persons who manufacture, trade in or certify electrical products;
  7. organizations that he considers are representative of or promote the interests of owners of commercial, industrial or domestic electrical installations or owners of electrical products;
  8. organizations that he considers represent the interests of the construction industry.

Category (8) is applicable only to an appeal against a decision or action of the Director under section 11 or 12 of the Electricity Supply Lines (Protection) Regulation in which the Appeal Board appointed shall consist of a public officer, one member from each of categories (1), (2) and (3) and 2 members from category (8).

A member shall be appointed for a term of 3 years and may be reappointed at the end of a term.

The Powers

  1. The appeal board may, by notice under the signature of the chairman of the appeal board -
    1. order a person to attend before the board and give evidence;
    2. order a person to produce documents;
    3. authorize a person to inspect an electrical installation; or
    4. authorize a person to inspect an electrical product and for that purpose authorize entry to premises, other than domestic premises, where an electrical product is exhibited or kept for the purpose of sale or hire; and in the case of appeal against notices under section 11 or 12 of the Electricity Supply Lines (Protection) Regulation -
    5. authorize a person to inspect a works site or former works site and, for that purpose, to authorize entry into premises other than domestic premises on which the works site is or was situated.

  3. The appeal board may make any order it thinks fit with regard to the payment of costs of the proceedings under Section 47 of the Electricity Ordinance and the costs of the Director or of any person in respect of whom the proceedings are brought.
