Contract for Supply of Auto-LPG at the Dedicated LPG Filling Station at Chai Wan

Description

The Government will allow the use of the land at nil premium with the ceiling retail price of Auto-LPG governed by an Auto-LPG pricing adjustment mechanism under the Contract. The operator will be responsible for the design, construction and operation of the LPG filling station as well as all associated expenses incurred for a period of 10 years, from the date to be notified by the Government upon the award of the Contract. At the end of the Contract, the operator shall clear the site or transfer all facilities on the site to the Government if so required by the Government. The Contract is scheduled to be awarded in mid-2021. The design and construction of the LPG filling station have to be completed within 180 days from the date to be notified by the Government upon the award of the Contract, and the LPG filling station has to be operated by the operator until expiry or termination of the Contract.

Contractors Invited to Tender

Open tendering is adopted. All interested contractors/suppliers/service providers with the following qualifications are invited to tender:

  1. be a Registered Gas Supply Company under the Gas Safety (Registration of Gas Supply Companies) Regulations; or
  2. be a company which has entered into an LPG Supply Agreement and a Technical Support Arrangement with a Registered Gas Supply Company; or
  3. have demonstrated that he has the capability to become a Registered Gas Supply Company; or
  4. have provided a letter of intent in his tender from a Registered Gas Supply Company that the Registered Gas Supply Company shall enter into an LPG Supply Agreement and a Technical Support Agreement with him if his tender is successful.

Note:

  1. The Registered Gas Supply Company shall refer to a company that (a) is the holder of a certificate of registration as a Registered Gas Supply Company under the Gas Safety (Registration of Gas Supply Companies) Regulations (Cap. 51E) and whose scope of registration includes the importation and supply of LPG; and (b) imports LPG which shall be stored at LPG terminal(s) at Tsing Yi.
  2. For tenderer of (2) above, he shall forward his tender with certified copies of the LPG Supply Agreement and Technical Support Agreement from the Registered Gas Supply Company.
  3. For tenderer of (3) or (4) above, if his tender is successful, he shall become a Registered Gas Supply Company or enter into an LPG Supply Agreement and a Technical Support Agreement with a Registered Gas Supply Company within 180 days from the date of award of the Contract.

Closing Date/Time

12.00 noon on Friday, 19 February 2021 26 February 2021

If tropical cyclone signal No. 8 or above is hoisted, or a black rainstorm warning signal or “extreme conditions after super typhoons” announced by the Government is/are in force at any time between 9.00 a.m. and 12.00 noon on Friday, 19 February 2021 26 February 2021, the tender closing time will be postponed to 12.00 noon on the first working day after the tropical cyclone signal No.8 is lowered, or the black rainstorm warning signal or the “extreme conditions after super typhoons” announced by the Government has/have ceased to be in force. In case of blockage of the public access to the location of the Specified Tender Box at any time between 9.00 a.m. and 12.00 noon on Friday, 19 February 2021 26 February 2021, the Government will announce extension of the tender closing time until further notice. Following removal of the blockage, the Government will announce the extended tender closing time as soon as practicable. The above announcements will be made via press releases on the website of Information Services Department (http://www.info.gov.hk/gia/general/today.htm).

Submission of Tender

Sealed tenders must be clearly marked with the tender reference and the subject of the tender on the outside of the envelope (but should not bear any indication which may relate the tender to the tenderer) addressed to the Chairman, Central Tender Board, and placed in the Government Secretariat Tender Box, situated in the Lobby of the Public Entrance on the Ground Floor, East Wing, Central Government Offices, 2 Tim Mei Avenue, Tamar, Hong Kong, before 12.00 noon on Friday, 19 February 2021 26 February 2021. Tenders must be deposited in the tender box as specified in this tender notice (“Specified Tender Box”) before the tender closing time. Late tenders and tenders not deposited in the Specified Tender Box will not be accepted.

Remarks

* The closing date for receipt of tenders shall be extended to 12:00 noon on Friday, 26 February 2021.

  1. Tenderer shall forward with his tender either a Tender Bond in the form as required by the Notes to Tenderers, or a cheque, banker’s draft or cashier’s order in a sum of HK$500,000 made payable to the Government of the Hong Kong Special Administrative Region, which sum shall be forfeited to the Government if any tenderer fails or refuses to implement an accepted tender. Monies cashed from any cheque, banker’s draft or cashier’s order will be returned to the unsuccessful tenders without interest.
  2. The Government of the Hong Kong Special Administrative Region does not bind itself to accept the tender with the highest combined score or any tender, and reserves the right to negotiate with any tenderer about the terms of the offer.
